Section 75 Agreement provides that the land under title PBL309, including the development site, must be held as one indivisible unit. This has the effect that the building plot, nor any part of the landholding, can be sold separately. Subsequent to the outline permission, a reserved matters application 08/00594/REM was approved in 2008. This contains a planning condition stating, “The occupation of the dwelling hereby permitted shall be limited to a person solely or mainly employed in the business located on the site.” Due to changes in policy, this planning condition may be able to be removed through formal process but at present it stands.
Right of Way:
A waymarked public path runs through Caerleebank Wood to the north of the subjects.
